Resumen
La STJUE declara que el Derecho de la Unión debe interpretarse en el sentido de que se opone a una normativa nacional relativa a un procedimiento sumario de pago de honorarios de abogado en virtud del cual la demanda presentada contra el cliente consumidor es objeto de una resolución dictada por una autoridad no jurisdiccional. De hecho, la intervención de un órgano jurisdiccional sólo se produce en la fase de recurso contra dicha resolución, si Jo hubiere, sin que en tal caso el órgano jurisdiccional pueda entrar a valorar ni el carácter abusivo de las cláusulas contenidas en el contrato que dio Jugar al litigio, ni tampoco sea factible aportar pruebas distintas a las aportadas al órgano no jurisdiccional. Asimismo, se valora desde la perspectiva de cláusulas abusivas o prácticas desleales -engañosas en concreto- el contrato celebrado entre un abogado y su cliente en el que se prohíbe a éste desistir del procedimiento sin conocimiento o contra el consejo de aquél y que estipula una penalidad económica para el caso de incumplimiento de esta prohibición.
ECJ declares that EU Law must be interpreted as prec/uding national /egis/ation re/ating to a summary procedure far the payment of /awyers» fees under which the c/aim brought against the consumer client is the subject of a decision given by a non-jurisdictional authority. In fact, the intervention of a court takes place only at the stage of the appeal against that decision, if any, without the court being able in such a case to assess either the unfairness of the terms contained in the contract which gave rise to the dispute or the possibility of adducing evidence other than that adduced befare the non-jurisdictional court. On the other hand, a contract concluded between a lawyer and his c/ient which prohibits the latter from withdrawing from the proceedings without his knowledge or against his advice and which stipulates a financia/ penalty in the event of non-compliance with that prohibition is assessed from the point of view of unfair terms or unfair practices - in particular, mis/eading terms.
