Resumen
En este trabajo se realiza una aproximación histórico-jurídica a lo que era la España de la época liberal para poder comprender el alcance jurídico y social de aquel período. Situados en aquel complejo contexto, y siguiendo la actividad legislativa de aquellos años, se esboza la influencia del liberalismo español en la redacción del primer texto constitucional y la primera codificación penal, prestando especial atención a los debates legislativos en torno al tratamiento de los detenidos y su dignidad. Finalmente se discute al respecto de la efectividad de aquella codificación, su vigencia y legado.
In this work a historical-legal approach is carried out to what was the Spain of the liberal era in order to understand the legal and social scope of that period. Located in that complex context and following the legislative activity of those years, is outlined the influence of Spanish liberalism in the drafting of the first constitutional text and the first criminal codification, paying special attention to the legislative debates about the treatment of the arrested and their dignity. Finally, it is discussed regarding the effectiveness of that coding, its validity and legacy.
