Resumen
Es de sobra conocido que, el derecho privado actual, encuentra su origen lejano en el derecho romano, de su casuística y enseñanzas han derivado la gran mayoría de figuras contractuales vigentes. El crecimiento económico de Roma hizo que una sociedad, esencialmente agraria, se integrase en el comercio, con fenicios y cartagineses, dando lugar al nacimiento del contrato de mandato. Concebido como un contrato consensual, bilateral imperfecto, esencialmente gratuito y basado en el officium de la amistad, el contrato que se configuró en Roma en el s. III a. C. permanece en nuestro ordenamiento jurídico, manteniendo aquellos elementos más relevantes que sirvieran de fundamento hace tres mil años.
It is well known that current private law has its distant origins in Roman Law; the vast majority of current contractual figures have been derived from its case law and teachings. The economic growth of Rome led to the integration of an essentially agrarian society into trade with the Phoenicians and Carthaginians, giving rise to the birth of the contract of mandate. Conceived as a consensual, imperfect bilateral contract, essentially gratuitous and based on the officium of friendship, the contract that was established in Rome in the 3rd century BC remains in our legal system, maintaining the most relevant elements that served as its foundation three thousand years ago.
