The main purpose of this research is to show a real and contrasted radiography of the legal and social situation in which ethnic and national minorities currently find themselves in the United States of America, measuring their impact on the American melting pot. At the same time, it will provide answers and concrete solutions in those cases in which the phenomenon of immigration is also present. The aspect that substantially interests us in the protection of these minorities is their consideration as a legal problem. Fundamentally, because it is part of the multi-level protection of human rights and fundamental freedoms and therefore has a scope that needs to be approached from different perspectives. To this end, we will use a methodology of sociological, legal and jurisprudential analysis within the framework of North American, public and comparative constitutional law. The results of the research will lead us to a series of final conclusions that will attempt to highlight the silence or oblivion that these communities have suffered in the process of building North American constitutional democracy. A scenario in which they emerge as mere "shadows", who have barely managed to shed light on the legal precepts originally established, so that they can be considered first-order actors in the Supreme Law of the "nation among nations".
