The protection of religious feelings has traditionally been given preferential status in Europe, with the different penal codes guaranteeing the protection of the majority religion against any type of verbal behaviour that would hurt the honour or religious feelings. Its configuration sometimes went beyond the free exercise of other fundamental rights such as freedom of artistic expression. In light of the international debate on the elimination of all forms of religious intolerance, which ended in General Assembly resolution 36/55 of 25 November 1981 on the Declaration on the Elimination of All Forms of Intolerance and Discrimination Based on Religion or Belief, the non-majoritarian religions fought for the equalisation of the level of protection given to Christianity in Europe. This article shows how the European Court of Human Rights (ECtHR) has been applying in its jurisprudence a balancing test on different levels when it comes to a confrontation between the protection of religious feelings and artistic expression. It also shows the different levels of protection granted to the majority religions in Europe.
