    The pandemic has caused a great impact on economies around the world to which it has been very difficult to react with some serenity and reflection. The political decisions adopted, apparently based on health recommendations, have generated far-reaching economic effects that have yet to be quantified and have required adaptations in record time to the prevailing forms of work in both the public and private sectors. One of the fundamental differences compared to previous crises such as that of 2007-13 is that the causes of the Covid- 19 crisis are known, although its consequences have not yet been accurately determined. This differential feature has the advantage that it allows governments to adopt measures to remedy it and to try to be prepared for what may come in the immediate future. This not only from the health point of view, which is obvious, but from the economic and labor market perspective too. In practical terms, if the lesson is assimilated and what has been learned is put into practice, it will be possible to avoid making the same mistakes to solve a similar situacion. This should be the message to try to temper both the sanitary and economic effects of the second wave of the pandemic, in whose frontispiece we seem to find ourselves. Although the 2008 crisis already revealed extraordinary weaknesses in the Spanish economy, its very strong dependence on construction (the so called the real estate boom) and the fragility of job stability in this "drag" sector of the economy, it has again been the real estate sector one of the most affected by the 2019 crisis. We have learned little and, what is worse, few adjustments have been made in the Spanish production model since then. The same can be preached about tourism. Spain has been for decades a power in this sense, competing for the top positions in the world ranking with countries such as France or the United States. It is true that the previous crisis also seriously harmed this sector, but far from modernizing and restructuring its production model, our country has lived off the income derived from the political instability of other rival states that have seen their potential visitors heading towards our territory as a consequence of the instability of their political regimes as a result of the so-called “Arab Spring”. What no one can deny is that we are facing an economic and labor crisis of which we still do not know the consequences and the duration. This is one of the first differences with respect to what happened a little over 10 years ago when certain imbalances could be visualized based mainly on an excess of debt -both public and private- mainly due to uncontrolled domestic demand, especially in Spain, but which no one was able to predict exactly. To try to clarify some of these issues in order to design future strategies for economic recovery, the following is a set of data provided by official sources and private organizations trying to measure the effects of the pandemic on economic aggregates and the labor market, as well as some personal reflections on the changes experienced in the economic model and those that are expected to occur, as a result of labor market adjustments, in the most immediate future.

    La gestión de crisis es uno de los elementos básicos de la prevención de conflictos. Su conocimiento requiere saber las causas que determinan la aparición de estas situaciones en las que una amenaza a valores, instituciones u objetivos prioritarios llega a crear una situación de riesgo en la que se percibe una divergencia en los intereses, creencias o aspiraciones de diferentes actores, que puede llevar al uso de la fuerza. Conocidas las causas, será mucho más fácil atajar sus posibles efectos, tratando, en un primer momento, de evitar que el conflicto se desencadene y, si ello no fuera posible, de procurar que sus consecuencias sean mínimas. Las dificultades añadidas para que la gestión de crisis sea eficaz son, por un lado, el entorno VUCA (Volátil, Incierto, Cambiante y Ambiguo) en el que las relaciones entre los Estados y el resto de actores en el ámbito internacional tienen lugar y, por otro, el carácter híbrido de los propios conflictos.

    Challenges of the Welfare State: The Spanish Case

    Recent events - especially the economic crisis- have revealed the need to maintain the welfare state, especially in developed countries (the most attacked by the crisis) which are also hit the hardest by the recession and job losses. On the one hand, the increase in demand for social services joins the decreased capacity to collect taxes as a result of the fall in economic activity and declining social contributions because of the rising unemployment. On the other, economic difficulties to prop up the welfare of citizens have caused the most unrest and political debate about whether social spending is precisely that what must suffer cuts to balance the public accounts. The answer of each country to this question will depend on its ability to meet new challenges without compromising the future of younger generations. The objective of this paper is to discuss the Spanish model of welfare, taking into special consideration the demographic effects of an aging population and the reversal of migration flows in order to discern which direction and what concrete measures can answer the previous question. This has been a response that in the Spanish case, has highlighted the need to review the excessive benevolence in granting a benefits system and the existing pockets of fraud in the tax system.

    La necesidad de repensar el Estado de Bienestar

    Iniciado el siglo XXI podemos plantearnos si es necesario revisar el Estado de Bienestar sobre el que con tanto ardor se debatió en los últimos años de la centuria pasada. El debate sobre el Welfare State no es nuevo ni será definitivo porque en el mismo inciden componentes de diversa naturaleza: ideológica, económica, política... que contribuyen, más que a aclarar las coordenadas sobre las que el mismo debe desarrollarse, a mezclar los argumentos a su favor y en su contra. El objetivo de estas reflexiones es doble: por un lado se pretende poner de relieve cuáles han sido los factores que contribuyeron inicialmente al éxito y expansión de los modernos sistemas de bienestar y cuáles los que de forma recurrente los han llevado a una situación crítica de forma que han pasado de considerarse la gran conquista política de la modernidad a ser el límite estructural de la misma. Por otro lado, la constatación del hecho de que los sistemas de bienestar han resistido de forma numantina las reiteradas situaciones que abogaban por su reducción y/o desmantelamiento inspira el segundo objetivo: apuntar cuáles pueden ser sus posibles líneas de reforma. La reforma podría seguir tres orientaciones que, lejos de ser mutuamente excluyentes, se complementan: la redistribución intrapresupuestaria de recursos con el fin de liberar fondos para las funciones de bienestar, manteniendo el saldo presupuestario vigente; la adopción de medidas que permitan allegar per se más recursos para este propósito sin afectar al resto de partidas presupuestarias y el aumento de la eficiencia del gasto social. Esta trilogía comporta la asunción de que debe seguir siendo el sector público quien continúe asumiendo las funciones que han venido determinando el contenido del Welfare State, rechazando las posibles posturas privatizadoras de la provisión de las distintas manifestaciones de su acción protectora, lo cual es compatible con la producción privada de determinados servicios y con la explicitación de los costes reales que suponen las distintas prestaciones que actualmente se suministran, con el fin de corresponsabilizar a los usuarios y despertar en ellos la conciencia de que existe un vínculo entre lo que se recibe en concepto de beneficiario y lo que se contribuye a financiar en concepto de contribuyente y/o cotizante. Esto supondría, en definitiva, colocar en manos de los consumidores la decisión de cómo distribuir la protección social entre los poderes públicos y el mercado sin olvidar que hay que conciliar el Estado de Bienestar que se desea con el que permiten ciertas variables económicas y con el que se está dispuesto a financiar.

    La gestión de las migraciones. El impacto económico de los migrantes

    El fenómeno de las migraciones forma parte de la historia de la humanidad y en su desarrollo y explicación están implicadas variables de muy diferente naturaleza: económicas, políticas, jurídicas, demográficas, medioambientales, humanitarias y personales. Por ello su estudio debe tratar de hacerse desde un enfoque interdisciplinar y holístico, al igual que su gestión. Sin embargo, la prevalencia de las causas económicas y de las repercusiones de esta misma consideración hacen que deban ser tenidas en cuenta de forma especial. La obra que se presenta pretende ofrecer un planteamiento plural a la hora de abordar el estudio de los movimientos de población y proponer medidas orientadas a una mejor gestión de los flujos migratorios. De la mano de dos profesoras universitarias con amplia trayectoria en el análisis de las migraciones, una rumana, la Profesora Enache, y otra española, la Profesora González- Rabanal, se presenta una investigación jurídico-económica de estas cuestiones, con el conocimiento adicional que proporciona el pertenecer a dos países con fuertes vínculos en lo concerniente a las migraciones europeas recientes, Rumanía, uno de los principales emisores de emigrantes, y España, uno de los destinos prioritarios de esta emigración. Confiamos en que con la lectura de este libro contribuya a desarrollar una visión crítica y constructiva a la hora de ver lo claro y lo “no tan claro” concerniente a las migraciones contemporáneas.

    This book is the result of the work of a group of Law and Ecomics professors, mostly from the Universidad Nacional de Educación a Distancia (UNED), within the scheme of the Network of Educational Innovation as convened by the UNED in the academic year of 2015/2016. The particular Project that has been developed in the mentioned call and reflected in this book is named “Practical Application of theoretical knowledge in Law and Economics: A Bilingual and Interdisciplinary Approach”. It has been conceived as a continuation of some previous work, also carried out by the authors of this book, in which basic aspects of the Spanish Legal and Economic systems were explained from a theoretical point of view. So once the theoretical analysis and explanation of both legal and economic issues was accomplished, we have completed the training path by providing a practical approach. In order to achieve this objective we have elaborated different kind of exercises through which to put in to practice the theoretical contents. It is important to highlight the relevance of this dynamic as not only it allows the reader to assess the extent of his knowledge but also it reveals the utility of the disciplines in question. Despite the fact that the present book embraces a different approach from the mentioned theoretical studies that precede it, it shares their international orientation as well as their root. Indeed, the whole idea of elaborating academic materials in English related to Spanish legal and economic disciplines emerged eight years ago within the Erasmus IP Program that the UNED, together with two other European Distance Education Universities (Fern Universität in Germay and Open Universiteit in the Netherlands) have been implementing ever since. The program is conducted entirely in English and it is conceived for Law students from these UE countries that are willing to initiate, in an international environment, a comparative legal analysis of the Dutch, German and Spanish systems as part of their academic training. However, this book (as well as the mentioned previous works) is also intended to be of use for any Spanish student that is currently taken a bilingual degree in Law and for any Anglo speaker researcher or practitioner that needs to familiarize with the basic aspects of the Spanish legal and economic system as part of their professional or academic career.

    La transferencia en el ámbito de las Ciencias Sociales: un reto posible
