Establece el art. 37.1 CE que «la ley garantizará el derecho a la negociación colectiva laboral entre los representantes de los trabajadores y empresarios, así como la fuerza vinculante de los convenios». La opción asumida por el constituyente fue la de configurar de una manera abierta y flexible la titularidad del derecho, sin perjuicio de que la recurrente relación entre los derechos a la libertad sindical y a la negociación colectiva alce al sindicato a la consideración de sujeto privilegiado del modelo, conforme a la opción consagrada en el RD Ley 7/2011. Es el Título III ET el que regula detalladamente el proceso de negociación colectiva estatutaria, reconociendo eficacia personal general y normativa a los acuerdos negociados conforme a lo disciplinado en dicha ley. En la última parte del trabajo se analiza el art. 84.2 ET, que dota de un papel central al ámbito empresarial para la configuración del modelo de regulación paccionada de condiciones de trabajo al situar a la empresa como centro de gravedad del sistema de negociación colectiva estatutaria.
Article 37.1 of the Spanish Constitution establishes that ‘the law shall guarantee the right to collective bargaining between workers' representatives and employers, as well as the binding force of agreements.’ The option taken by the constituent assembly was to configure the ownership of the right in an open and flexible manner, without prejudice to the fact that the recurring relationship between the rights to freedom of association and collective bargaining elevates the trade union to the status of a privileged subject of the model, in accordance with the option enshrined in Royal Decree Law 7/2011. Title III of the Workers' Statute regulates in detail the statutory collective bargaining process, recognising the general personal and regulatory effectiveness of agreements negotiated in accordance with the provisions of said law. Finally, Article 84.2 of the Workers' Statute is analysed, which gives a central role to the business sphere in shaping the model for the negotiated regulation of working conditions by placing the company at the centre of the statutory collective bargaining system.
