Con todos sus defectos, aquella declaración de derechos supuso una auténtica revolución en las relaciones entre las personas frente a sus Estados. A setenta y cinco años de aquella consecución, nos enfrentamos a desafíos desconocidos en los que algunos de los derechos (incompletamente) adquiridos del compromiso de los Estados, son ahora amenazados por unas pocas sociedades que configuran y gestionan la generación de la inteligencia artificial. En el presente estudio se realiza una breve aproximación a algunos de los riesgos que entrañan la inteligencia artificial y el control algorítmico y se analizan las iniciativas legislativas que se pretenden abordar con el fin de tratar de alcanzar la deriva de deslocalización de la protección de los derechos fundamentales a la que se adentran nuestras sociedades.Could it be asked what the degree of human evolution would have been like if in our pursuit of rights, we had not yet reached that achievement, even incomplete, represented by the Universal Declaration of Human Rights of 1948? Despite all its defects, that declaration of rights represented a true revolution in the relations between people and their States. Seventy-five years after that achievement, we face unknown challenges in which some of the rights (incompletely) acquired by the commitment of States are now threatened by a few societies that configure and manage the generation of artificial intelligence.
