Resumen
El artículo se enmarca en la regulación de las relaciones existentes entre la Organización
Internacional del Trabajo (OIT) y sus agentes en un ambiente laboral cada día más
afectado por la precarización. Su objetivo es realizar un análisis crítico del actual sistema
interno de resolución de controversias laborales en la OIT teniendo en cuenta su evolución
desde la creación de esta organización y las reformas más recientes. La OIT juega un papel
determinante en las relaciones laborales de numerosas organizaciones internacionales
por la trascendencia de la jurisprudencia del Tribunal Administrativo de la OIT (TAOIT),
cuyas sentencias han ido incorporando progresivamente principios relativos al derecho
fundamental a un debido proceso para la resolución de las controversias laborales internas.
De la misma forma, los nuevos mecanismos internos de resolución de controversias
laborales previos a la vía judicial refuerzan en general su eficacia y efectividad, incorporando
igualmente los desarrollos más relevantes en el área de protección laboral de los
derechos humanos en aspectos tan relevantes como el entorno multicultural, el acoso laboral
y el acoso sexual en el ámbito laboral. Dada la trascendencia internacional de la OIT
dichas reformas internas probablemente influirán en los nuevos desarrollos legislativos
de sus Estados miembros. Para la realización de este artículo se ha partido de un estudio
pormenorizado de la documentación de la OIT relativa a la resolución de controversias
laborales internas y la jurisprudencia del TAOIT, así como de la doctrina más relevante
en la materia, para determinar los avances más significativos en la protección y defensa
de los derechos de los trabajadores internacionales al encontrarse fuera del amparo de los
sistemas estatales nacionales.
The article is framed in the regulation of existing relations between the International Labor Organization (ILO) and its agents in a work environment that is increasingly affected by precariousness. Its objective is to carry out a critical analysis of the current internal system for resolving labor disputes in the ILO, considering its evolution since the creation of this organization and the most recent reforms. The ILO plays a determining role in the labor relations of numerous international organizations due to the importance of the jurisprudence of the ILO Administrative Tribunal (ILOAT), the rulings of which have progressively incorporated principles related to the fundamental right to due process for the resolution of internal labor disputes. In the same way, the new internal mechanisms for resolving labor disputes prior to judicial proceedings generally reinforce their efficiency and effectiveness, also incorporating the most relevant developments in the area of labor protection of human rights in aspects as relevant as the environment. multicultural, workplace harassment and sexual harassment in the workplace. Given the international significance of the ILO, such internal reforms will probably influence new legislative developments in its member states.
