La norma del artículo 541 de la LEC constituye el eje principal
de este estudio. Se analizan las consecuencias de su aplicación en el ámbito
del Registro de la Propiedad, focalizando el interés en el conflicto entre la
posición del cónyuge no deudor, pero titular de bienes susceptibles de
responsabilidad, y el derecho del acreedor a la satisfacción de su crédito.
The rule of Article 541 of the LEC is the main focus of this study. The consequences of its application in the field of the Land Registry are analysed, focusing the interest on the conflict between the position of the non-debtor spouse, but holder of assets susceptible of liability, and the creditor’s right to the satisfaction of his or her claim.
